These Terms and Conditions ("Terms"), together with the Privacy Policy (https://museumticket.istanbul/privacy-policy), govern your use of the services provided by Authentic Day Tour, LLC ("Authentic Day Tour," "we," "us," or "our") through the website museumticket.istanbul (the "Platform").
By accessing or using the Platform, creating an account, or making a Booking, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Platform. In all Bookings, the person making the Booking shall be deemed to have accepted these Terms on behalf of all persons named in the Booking.
These Terms have been drafted in, and shall be construed in, the English language. These Terms may be translated into other languages for your convenience. In the event of any discrepancy, inconsistency, or conflict between the English version and any translated version, the English version shall prevail and govern the interpretation and enforcement of these Terms. Any legal proceedings arising from or related to these Terms shall be conducted based on the English version.
I. DEFINITIONS
The following terms are used throughout these Terms:
"Authentic Day Tour" refers to Authentic Day Tour, LLC, the company that operates the Platform.
"Booking" refers to the purchase of a ticket, experience, or tour through the Platform.
"Booking Confirmation" refers to the confirmation message (sent via email and/or WhatsApp) issued by Authentic Day Tour upon successful completion of payment for a Booking.
"Booking Price" refers to the total amount charged to you at checkout for a Booking, including all applicable taxes and fees.
"Experience" refers to a museum visit, attraction entry, guided tour, or any other tourism service offered through the Platform.
"Platform" refers to the website museumticket.istanbul, including all pages, features, and services accessible through it.
"Posted Price" refers to the price displayed on the Platform for an Experience.
"Service Provider" refers to the local tourism agencies based in Istanbul, Turkey, that supply and operate the Experiences offered through the Platform.
"Supplier Terms" refers to any additional terms and conditions specified by a Service Provider that apply to a particular Experience.
"Tour Guide" refers to the professional tourist guides, employed or contracted by our Service Providers, who provide guided tour experiences or facilitate physical ticket pickups.
"User Content" refers to any content submitted by you through the Platform, including reviews, photos, videos, comments, and other materials.
"Venue Operator" refers to the museums, attractions, and other venues whose tickets or Experiences are offered through the Platform.
"You" or "Your" refers to any individual who accesses or uses the Platform, whether as a visitor, registered user, or customer.

We operate the Platform as a curated marketplace through which local tourism agencies ("Service Providers") offer various travel experiences, including museum tickets, attraction entries, and guided tours (collectively, "Experiences"), for purchase. We facilitate the Bookings, but the actual Experiences are provided and operated by the Service Providers themselves, not by Authentic Day Tour.
Service Providers are independent contractors and not agents or employees of Authentic Day Tour. Authentic Day Tour is not responsible or liable for any actions, errors, omissions, representations, warranties, breaches, negligence, or misconduct of Service Providers, Tour Guides, or Venue Operators, nor for any damages, personal injury, death, or other loss or expense arising from Bookings or Experiences, except as expressly stated in these Terms.
III. SCOPE
3.1. These Terms apply to all visitors and users of the Platform and govern your use of its content and services. As soon as you use any portion of the Platform, you are obliged to comply with these Terms.
3.2. These Terms apply to all of our services unless more specific terms apply to a particular service. In such cases, we will clearly inform you of the applicable terms. Any terms that conflict with or differ from these Terms will not apply unless we have expressly agreed to them in writing.
3.3. We are not obligated to improve, update, or continue to make available the content, functions, or services provided via the Platform. We may discontinue our services at any time; however, if you have already completed a Booking, the terms applicable to that Booking remain in effect.
IV. USE OF THE PLATFORM
4.1. The Platform is provided for your personal, non-commercial use only. Any use of the Platform for business, commercial, or professional purposes is strictly prohibited unless you have entered into a separate written agreement with us. In particular, the commercial resale of tickets or any other activities intended to generate profit — whether for yourself or for third parties — is not permitted under any circumstances. 4.2. You must be at least 18 years of age to use the Platform and make Bookings. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
4.3. As a condition of your use of the Platform, you represent and warrant that:
- (a) all information supplied by you in the course of your use of the Platform is true, accurate, current, and complete;
- (b) you will use the Platform only for lawful purposes and in accordance with these Terms;
- (c) you will not make any speculative, false, or fraudulent Bookings;
- (d) you have full power and authority to enter into this legally binding agreement and in doing so will not violate any other agreement to which you are a party.
4.4. We retain the right, at our sole discretion, to deny access to the Platform to anyone at any time and for any reason, including, but not limited to, violation of these Terms.
V. ACCOUNTS
5.1. Registration is not required to browse the Platform. However, you must create an account to access certain features and to make Bookings. You may create an account using:
- (a) Email magic link authentication; or
- (b) Google Sign-In.
5.2. You are responsible for maintaining the confidentiality of your account credentials. You are solely responsible for all activities that occur in connection with your account, including all Bookings. You must immediately notify us at [email protected] if you suspect that your account has been compromised or that there has been any unauthorized use of your account.
5.3. You may not transfer your account to another person.
5.4. If you wish to delete your account, you may request deletion by contacting us at [email protected]. Upon receiving your request, we will delete your account in accordance with our Privacy Policy. Please note that deletion of your account does not automatically cancel any active Bookings.
5.5. We may terminate or suspend access to your account at our sole discretion, without prior notice, for any reason, including but not limited to violation of these Terms, suspected fraud, or misuse of the Platform. Any such termination or suspension may prevent you from accessing your account, the Platform, and any related information.
VI. SEARCHING AND BOOKING
6.1. You can search for Experiences using the various options made available on the Platform. Search results are based on relevance to your search criteria and other factors.
6.2. When you Book an Experience on the Platform, you are purchasing the Experience from the relevant Service Provider. By completing a Booking, you submit a binding offer to purchase the Experience. Upon successful payment, we will issue a Booking Confirmation on behalf of the Service Provider.
6.3. Your Booking Confirmation, including your e-ticket(s) and relevant details, will be sent to you via:
- (a) Email; and
- (b) WhatsApp (where you have provided your phone number).
6.4. It is your responsibility to verify that all details in your Booking Confirmation are correct immediately upon receipt. If you notice any errors, you must contact us promptly at [email protected].
6.5. For certain Experiences, the Service Provider may have its own terms and conditions ("Supplier Terms"). By completing a Booking for such an Experience, you agree to be bound by the applicable Supplier Terms. Please read these Supplier Terms carefully, as they may contain important information regarding the Experience, including participation requirements and additional conditions. In the event of a conflict between the Supplier Terms and these Terms concerning your relationship with Authentic Day Tour, these Terms shall prevail.
6.6. You must arrive on time at the meeting point as stated in the Experience description on the Platform or as communicated in your Booking Confirmation. If you are traveling from abroad, you are responsible for obtaining the necessary travel documents (such as passport and visa) and for complying with all applicable health and entry requirements.
VII. PRICING AND PAYMENTS
7.1. Prices and Currency
- (a) The Posted Price for each Experience is displayed on the Platform. Unless otherwise stated, Posted Prices are inclusive of all applicable taxes.
- (b) The Platform supports multiple currencies. Prices will be displayed in the currency selected by you. Currency conversions are performed at the prevailing exchange rate as determined by our payment processor at the time of the transaction. Your bank or payment card company may apply additional conversion fees, resulting in differences between the amount displayed on the Platform and the final amount charged to you. We recommend contacting your bank or card company if you have questions regarding currency conversion fees.
- (c) Price quotations are subject to change without notice until a Booking has been completed.
7.2. Payment Processing
- (a) All payments on the Platform are processed through Stripe, Inc. ("Stripe") using Stripe Connect. Authentic Day Tour operates as a marketplace platform; payments are collected on behalf of the relevant Service Provider through Stripe's marketplace infrastructure.
- (b) Full payment is required at the time of Booking unless otherwise specified.
- (c) Your payment information (including credit or debit card details) is transmitted directly to Stripe's secure servers. We do not collect, store, or have access to your full payment card information at any time. For more information, please refer to our Privacy Policy and Stripe's privacy policy at https://stripe.com/privacy.
- (d) You must provide payment information truthfully. You represent and warrant that you are authorized to use the payment method you select.
- (e) We reserve the right to decline or cancel any Booking where we suspect fraud, unauthorized payment, or a violation of these Terms.
7.3. Tax Invoices
Authentic Day Tour is a marketplace facilitator and does not issue tax invoices for Bookings. Upon request, we may issue a payment confirmation for a completed Booking. You may request a payment confirmation by contacting us at [email protected].
VIII. TICKET DELIVERY AND OUR GUARANTEE
8.1. Ticket Delivery
Upon completion of your Booking, you will receive your e-ticket(s) via email and/or WhatsApp. For certain Experiences, you may be required to meet a Tour Guide at a designated meeting point to receive a physical ticket or gain entry to the venue.
8.2. Our Guarantee
We are committed to delivering the right tickets, on time, every time. Our guarantee covers the following:
- (a) Ticket Guarantee
If the tickets issued by Authentic Day Tour reflect a different date, time, or option than what you selected, or if tickets are delayed or not delivered in time due to an error on our side, or if tickets do not work at the venue because of a processing or technical issue attributable to us, we will:
- First, attempt to resolve the issue by issuing corrected tickets ("fix-first" approach); and
- If corrected tickets cannot be provided in time, offer you a full refund or an exchange for a different Experience, at your choice.
- (b) Experience Guarantee
If the Experience cannot be provided as described due to circumstances attributable to the Service Provider or Venue Operator, including but not limited to:
- The venue closes unexpectedly;
- The Service Provider cancels the Experience;
- The Tour Guide does not show up for a guided Experience;
- Any material inclusions promised as part of your Booking are missing;
We will offer one of the following remedies:
- Rebooking: With your consent, we will rebook you on an equal or similar Experience at no additional cost; or
- Refund: If you do not wish to rebook, you will receive a full refund.
8.3. Exclusions
Our guarantee does not apply where:
- (a) The Booking is cancelled by you;
- (b) Issues are attributable to you, including incorrect information provided by you, late arrival, failure to comply with entry requirements, or no-show;
- (c) You selected the wrong date, time, or ticket option;
- (d) Ticket failure is caused by venue technical systems, entry system failures, or scanning hardware issues outside our control;
- (e) Delay or non-delivery was caused by your email settings or incorrect contact information.
8.4. Claiming Benefits
To claim benefits under our guarantee, you must:
- (a) Contact us at [email protected] within 24 hours of the issue;
- (b) Provide your Booking details; and
- (c) Provide reasonable evidence (such as screenshots, venue rejection proof, or relevant communications).
Failure to report within the required timeframe may limit or void your eligibility.
IX. BOOKING MODIFICATIONS
9.1. Date and Time Changes
You may change the date and/or time of your Booking free of charge, subject to availability, through the self-service options available on the Platform. No need to contact us — you can make these changes directly from your Booking management page before the scheduled start time of your Experience.
9.2. Venue or Experience Changes
If you wish to change your Booking to a different museum or Experience, you may do so through the Platform, subject to availability. If the new Experience has a higher price, you will be required to pay the price difference. If the new Experience has a lower price, the difference (minus any applicable transaction processing fee) will be refunded to you.
9.3. Processing Modifications
All modifications must be made prior to the scheduled start time of the original Experience. Modifications are subject to the availability of the requested date, time, or Experience. Upon completing a modification, you will receive an updated Booking Confirmation via email and/or WhatsApp. This updated confirmation will serve as proof of the change and should be retained.
X. CANCELLATIONS, REFUNDS, AND EXCHANGES
10.1. Cancellation by You
- (a) You may cancel a Booking up to 24 hours before the scheduled start time of the Experience for a refund, subject to Section 10.3.
- (b) For cancellations made within 24 hours prior to the start of the Experience, no refund will be issued.
- (c) If you have not yet viewed your e-ticket and less than 24 hours remain before the scheduled start time, you may be eligible to exchange your Booking for a different Experience, subject to availability.
- (d) No refunds or exchanges are available once an Experience has commenced.
- (e) No refunds are available in the event of a no-show.
10.2. Cancellation by Service Provider or Force Majeure
- (a) If the Service Provider cancels the Experience for any reason, you will receive a full refund of the Booking Price.
- (b) In the event that an Experience is cancelled or cannot be performed due to force majeure events — including but not limited to natural disasters, pandemics, epidemics, government actions, strikes, acts of terrorism, severe weather conditions, or other circumstances beyond the reasonable control of Authentic Day Tour or the Service Provider — you will receive a full refund of the Booking Price.
10.3. Refund Processing
- (a) Refunds will be issued to the original payment method used for the Booking.
- (b) Refunds will be the Booking Price minus the applicable transaction processing fee charged by our payment processor.
- (c) Authentic Day Tour will initiate the refund within 7 business days of confirming the cancellation. The actual time for the refund to appear in your account may vary depending on your bank or payment provider.
10.4. Cancellation by Authentic Day Tour
We reserve the right to cancel a Booking at our sole discretion if we suspect fraud, violation of these Terms, or any other circumstances that we reasonably believe warrant cancellation. In such cases, you will receive a full refund of the Booking Price (minus the applicable transaction processing fee), unless the cancellation was caused by your fraudulent activity, in which case no refund will be issued.
XI. YOUR RESPONSIBILITIES AND ASSUMPTION OF RISK
11.1. You are responsible and liable for your acts and omissions during the use of the Platform and participation in any Experience. You are also responsible for the acts and omissions of anyone for whom you have made a Booking.
11.2. You are responsible for:
- (a) Arriving on time at the designated meeting point;
- (b) Ensuring that you and all participants meet the participation requirements specified in the Experience description;
- (c) Complying with all instructions given by the Tour Guide, Venue Operator, or their staff;
- (d) Complying with all applicable local laws, rules, and regulations;
- (e) Obtaining any necessary travel documents (passport, visa, etc.) and complying with all health and entry requirements;
- (f) Leaving the venue in the same or substantially the same condition as when you arrived.
11.3. You acknowledge that certain Experiences may carry inherent risks, including but not limited to risks of illness, bodily injury, or property damage. By making a Booking and participating in an Experience, you voluntarily assume all risks arising from your participation, to the maximum extent permitted by applicable law.
11.4. The Booking Price does not include any type of insurance. You are solely responsible for obtaining sufficient insurance coverage, including travel insurance and personal liability insurance, as appropriate for your planned activities.
XII. SERVICE PROVIDERS AND SUPPLIER TERMS
12.1. The Experiences offered on the Platform are supplied and operated by independent Service Providers. When you make a Booking, you are purchasing the Experience from the relevant Service Provider. Authentic Day Tour acts as a marketplace facilitator, not as the provider of the Experience itself.
12.2. Service Providers are independent contractors and not agents, employees, or representatives of Authentic Day Tour. We do not control, direct, or supervise the manner in which Service Providers conduct their Experiences.
12.3. Certain Experiences may be subject to Supplier Terms in addition to these Terms. By completing a Booking, you acknowledge and agree that you have read, understood, and accepted any applicable Supplier Terms. In the event of a conflict between the Supplier Terms and these Terms regarding your relationship with Authentic Day Tour, these Terms shall prevail.
12.4. Authentic Day Tour is not responsible or liable for:
- (a) The acts, errors, omissions, representations, warranties, breaches, negligence, or misconduct of any Service Provider, Tour Guide, or Venue Operator;
- (b) Any personal injury, death, property damage, or other loss or expense arising from or related to any Experience;
- (c) The accuracy, completeness, or reliability of any information provided by a Service Provider regarding an Experience;
- (d) Any delay, cancellation, or change to an Experience caused by the Service Provider, Tour Guide, or Venue Operator;
except as expressly stated in Section VIII (Ticket Delivery and Our Guarantee) and Section X (Cancellations, Refunds, and Exchanges) of these Terms.
XIII. DISCLAIMER OF WARRANTIES
13.1. THE PLATFORM AND ALL CONTENT, SERVICES, AND EXPERIENCES ACCESSIBLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
14.2. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUTHENTIC DAY TOUR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
13.3. WITHOUT LIMITING THE FOREGOING, AUTHENTIC DAY TOUR DOES NOT WARRANT THAT:
- (a) THE PLATFORM WILL MEET ALL OF YOUR REQUIREMENTS;
- (b) THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
- (c) THE INFORMATION, CONTENT, OR DESCRIPTIONS OF EXPERIENCES ON THE PLATFORM WILL BE COMPLETE, ACCURATE, OR FREE FROM TECHNICAL DEFECTS;
- (d) ANY DEFECTS IN THE PLATFORM WILL BE CORRECTED.
13.4. AUTHENTIC DAY TOUR DOES NOT ENDORSE, WARRANT, OR GUARANTEE THE EXISTENCE, CONDUCT, PERFORMANCE, SAFETY, QUALITY, LEGALITY, OR SUITABILITY OF ANY SERVICE PROVIDER, EXPERIENCE, OR VENUE.
13.5. YOUR USE OF THE PLATFORM AND PARTICIPATION IN ANY EXPERIENCE IS AT YOUR OWN RISK. THESE DISCLAIMERS APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD OR FRAUDULENT MISREPRESENTATION.
XIV. LIMITATION OF LIABILITY
14.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AUTHENTIC DAY TOUR, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF USE, LOSS OF GOODWILL, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF AUTHENTIC DAY TOUR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
14.2. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUTHENTIC DAY TOUR'S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, YOUR USE OF THE PLATFORM, YOUR PARTICIPATION IN ANY EXPERIENCE, OR ANY BOOKING SHALL NOT EXCEED THE BOOKING PRICE PAID BY YOU FOR THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM.
14.3. THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION REFLECT THE ALLOCATION OF RISK BETWEEN THE PARTIES. THESE LIMITATIONS SHALL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
14.4. Authentic Day Tour is not liable for any acts, errors, omissions, representations, warranties, breaches, negligence, or misconduct of any Service Provider, Tour Guide, or Venue Operator. All claims related to personal injury, death, property damage, or other loss arising from or related to an Experience must be directed to the relevant Service Provider.
14.5. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
XV. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Authentic Day Tour and its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- (a) Your breach of these Terms or any applicable Supplier Terms;
- (b) Your violation of any applicable law, rule, or regulation;
- (c) Your use of the Platform, including any Booking you make;
- (d) Your participation in any Experience;
- (e) Any User Content you submit;
- (f) Your negligence or willful misconduct;
- (g) Your violation or infringement of the rights of any third party.
XVI. USER CONTENT
16.1. Submission of User Content
You may submit User Content through the Platform, including photos, videos, reviews, and comments. You are solely responsible for any User Content you submit. You assume all risks associated with such User Content, including anyone's reliance on its accuracy, completeness, or usefulness.
16.2. License Grant
By submitting User Content, you grant Authentic Day Tour a worldwide, non-exclusive, royalty-free, fully paid-up, perpetual, transferable, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from, and publicly display and perform such User Content throughout the world, in any media now known or hereafter developed, for any purpose related to the operation and promotion of the Platform and our services. You also grant Authentic Day Tour the right to use the name you submit in connection with such User Content.
16.3. User Content Standards
By submitting User Content, you represent and warrant that:
- (a) You own or have the necessary rights and permissions to use, and to authorize our use of, such User Content as described herein;
- (b) The User Content is accurate and not misleading;
- (c) The User Content does not violate these Terms, any applicable law, or the rights of any third party.
You expressly agree not to submit User Content that:
- (a) Is unlawful, defamatory, obscene, pornographic, threatening, harassing, or otherwise objectionable;
- (b) Infringes any patent, trademark, trade secret, copyright, or other intellectual property right of any party;
- (c) Contains viruses, malware, or other harmful code;
- (d) Impersonates any person or entity;
- (e) Contains advertising, promotions, or solicitations;
- (f) Contains private information of any third party without their consent.
16.4. Moderation
Authentic Day Tour reserves the right, but has no obligation, to monitor, review, edit, or remove any User Content at any time and for any reason, at our sole discretion. We are not responsible for any User Content posted by you or any third party.
XVII. INTELLECTUAL PROPERTY
17.1. Platform Content
The Platform and all of its content — including but not limited to text, photographs, images, graphics, illustrations, videos, designs, icons, software, code, and the compilation thereof — is owned by Authentic Day Tour or its licensors and content creators, and is protected by copyright, trademark, and other intellectual property laws. All rights are reserved.
17.2. Restrictions
You agree not to:
- (a) Copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content from the Platform without our prior written consent;
- (b) Use any content from the Platform for any commercial purpose without our express written permission;
- (c) Remove, alter, or obscure any copyright, trademark, or other proprietary notices on the Platform.
17.3. Trademarks
"museumticket.istanbul" and "Authentic Day Tour" and any associated logos, designs, and marks are trademarks or trade names of Authentic Day Tour. All other trademarks, registered trademarks, product names, and company names or logos displayed on the Platform are the property of their respective owners.
XVIII. PROHIBITED ACTIVITIES
You agree that you will not, and will not assist or enable others to:
- (a) Use the Platform or its content for any commercial or unlawful purpose;
- (b) Access, monitor, or copy any Platform content using any robot, spider, scraper, or other automated means, or any manual process, without our express written permission;
- (c) Bypass or circumvent any measures employed to prevent or limit access to the Platform;
- (d) Take any action that imposes an unreasonable or disproportionately large load on our infrastructure;
- (e) Deep-link to any portion of the Platform without our express written permission;
- (f) "Frame," "mirror," or otherwise incorporate any part of the Platform into any other website without our prior written authorization;
- (g) Attempt to modify, decompile, disassemble, or reverse-engineer any software associated with the Platform;
- (h) Use the Platform to threaten, stalk, defraud, harass, or interfere with another user's use of the Platform;
- (i) Use the Platform to transmit any computer viruses, worms, or other malicious code;
- (j) Use any device, software, or routine that interferes with the proper working of the Platform;
- (k) Attempt to gain unauthorized access to the Platform, user accounts, or any systems connected to the Platform;
- (l) Purchase tickets through the Platform for the purpose of commercial resale;
- (m) Use the Platform in any manner that violates any applicable law or regulation.
Violation of any of the above may result in immediate termination of your access to the Platform and your account, without prior notice.
XIX. ELECTRONIC COMMUNICATIONS
19.1. When you use the Platform, contact us via email or WhatsApp, or create an account, you are communicating with us electronically. You agree that we may communicate with you electronically via email, WhatsApp, or by posting notices on the Platform.
19.2. You agree that all communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
XX. THIRD-PARTY LINKS
The Platform may contain hyperlinks to websites operated by parties other than Authentic Day Tour ("Third-Party Sites"). Such hyperlinks are provided for your reference only. Their presence on the Platform does not signify any endorsement by Authentic Day Tour of the material on such Third-Party Sites, nor any association with their operators. We do not control Third-Party Sites and are not responsible for their content, privacy policies, or practices. You access Third-Party Sites at your own risk.
XXI. DATA PROTECTION
We collect and process your personal data in accordance with the GDPR and other applicable laws. For detailed information on how we handle your data, your rights, and our security measures, please refer to our Privacy Policy, available at https://museumticket.istanbul/privacy-policy.
XXII. FRAUDULENT ACTIVITIES
22.1. We maintain a zero-tolerance policy for fraudulent activity on the Platform. Where we suspect that a transaction may be fraudulent, we may contact you to request additional information to verify the legitimacy of your Booking.
22.2. If you choose not to provide the requested information, or if we determine that the transaction is fraudulent, we reserve the right to cancel your Booking and/or suspend or terminate your account. Authentic Day Tour will not be responsible for any losses arising from such cancellations.
22.3. We strongly advise you to remain vigilant against phishing attempts. If you receive any suspicious communication claiming to be from Authentic Day Tour, please report it to [email protected] immediately.
XXIII. CHANGES TO THESE TERMS
23.1. We may update or modify these Terms from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will update the "Last Updated" date at the top of these Terms.
23.2. If we make material changes to these Terms, we will notify you by posting a prominent notice on the Platform or by sending you an email notification prior to the changes becoming effective.
23.3. Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Platform and contact us to close your account.
XXIV. TERMINATION
24.1. You may terminate your relationship with us at any time by ceasing to use the Platform and requesting deletion of your account by contacting us at [email protected].
24.2. We may terminate or suspend your access to the Platform and/or your account at any time, without prior notice, for any reason, including but not limited to:
- (a) Violation of these Terms;
- (b) Suspected fraud or illegal activity;
- (c) Extended period of inactivity;
- (d) Any other reason we deem necessary to protect the interests of Authentic Day Tour, other users, or Service Providers.
24.3. Termination of your account does not affect any existing Bookings that have already been confirmed. The provisions of these Terms that by their nature should survive termination — including but not limited to Sections XIII (Disclaimer of Warranties), XIV (Limitation of Liability), XV (Indemnification), XVI (User Content), XVII (Intellectual Property), and XXV (Governing Law and Jurisdiction) — shall survive and remain in full force and effect.
XXV. GOVERNING LAW AND JURISDICTION
25.1. These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of laws principles.
25.2. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Wyoming. Each party irrevocably consents to the personal jurisdiction of such courts.
25.3. The provisions of the United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.
25.4. Nothing in these Terms shall affect any mandatory consumer protection rights that you may have under the laws of your country of residence that cannot be excluded by contract.
XXVI. ASSIGNMENT
26.1. You may not transfer or assign your rights and/or obligations under these Terms without the prior written consent of Authentic Day Tour. Any purported assignment without such consent shall be void.
26.2. Authentic Day Tour may freely assign or transfer these Terms, or any of its rights or obligations hereunder, at its sole discretion, without notice to you.
XXVII. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be reformed to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the provision.
XXVIII. NO WAIVER
No waiver of any term or condition of these Terms shall be valid or binding unless made in writing and signed by Authentic Day Tour. Our failure to enforce any provision of these Terms at any time shall not be construed as a waiver of that provision or of our right to enforce it at a later time.
XXIX. EUROPEAN UNION CONSUMER RIGHTS
29.1. Right of Withdrawal
If you are a consumer residing in the European Economic Area (EEA), you may have the right to withdraw from a contract within 14 days without giving any reason, in accordance with EU Directive 2011/83/EU on consumer rights.
29.2. Exclusion of the Right of Withdrawal
However, in accordance with Article 16(l) of Directive 2011/83/EU, the right of withdrawal does not apply to contracts for the provision of leisure activities if the contract provides for a specific date or period of performance. The Experiences offered through the Platform — including museum tickets, attraction entries, and guided tours scheduled for specific dates and times — fall within this exclusion.
Accordingly, by completing a Booking for an Experience with a specific date, you acknowledge and agree that the right of withdrawal does not apply to your Booking, and that you waive your right of withdrawal upon confirmation of your Booking. Your cancellation rights are instead governed by Section X (Cancellations, Refunds, and Exchanges) of these Terms.
29.3. Mandatory Consumer Rights
Nothing in these Terms is intended to exclude or limit any mandatory consumer rights that you may have under the laws of your country of residence within the EEA, including rights that cannot be excluded or limited by contract.
XXX. ONLINE DISPUTE RESOLUTION
If you are a consumer residing in the European Economic Area (EEA), you may submit a complaint through the European Commission's Online Dispute Resolution (ODR) platform, which can be accessed at:

The ODR platform allows EU consumers to resolve disputes related to online purchases without going to court. When submitting a complaint, you may use our email address: [email protected].
Please note that the availability of the ODR platform does not oblige Authentic Day Tour to participate in alternative dispute resolution proceedings before a consumer arbitration board, unless required by applicable law.
XXXI. COPYRIGHT AND DMCA NOTICE
31.1. Authentic Day Tour respects the intellectual property rights of others and expects users of the Platform to do the same.
31.2. If you believe that your copyrighted work has been copied or used on the Platform in a way that constitutes copyright infringement, please send a written notice to [email protected] containing the following information, in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512):
- (a) An electronic or physical signature of the person authorized to act on behalf of the copyright owner;
- (b) A description of the copyrighted work that you claim has been infringed;
- (c) A description of where the allegedly infringing material is located on the Platform (including a URL or other specific reference sufficient for us to locate the material);
- (d) Your name, address, telephone number, and email address;
- (e) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- (f) A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
31.3. Upon receipt of a valid notice that substantially complies with the requirements above, Authentic Day Tour will investigate the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material.
XXXII. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any applicable Supplier Terms, constitute the entire agreement between you and Authentic Day Tour with respect to the Platform and supersede all prior or contemporaneous communications, representations, and agreements, whether electronic, oral, or written, between you and Authentic Day Tour regarding the Platform.
